Devin Nunes is the first Presidential Medal of Freedom recipient to lose lawsuit to a fake cow

January 9, 2021   Humor
Devin Nunes is the first Presidential Medal of Freedom recipient to lose lawsuit to a fake cow

Another Trump-Russia participation trophy, because Devin was so stupid he won’t get an indictment until Trump leaves office.

Nunes has filed multiple lawsuits characterized as Strategic Lawsuits Against Public Participation (“SLAPP“). Experts have described the lawsuits as “unlikely to succeed” and “virtually free of merit”.[134][135]

On March 18, 2019, Nunes filed a defamation lawsuit against Twitter, Elizabeth “Liz” Mair, Mair Strategies LLC, and the Twitter accounts, “Devin Nunes’s Mom” (@DevinNunesMom) and “Devin Nunes’s Cow” (@DevinCow), seeking $ 250 million in damages.[136] As the story went viral, the popularity of the defendants’ accounts soared, gaining more followers than Nunes’s own account.[137] The San Francisco Chronicle cited this as an example of the Streisand Effect.[138] Kathryn Watson of CBS News said the filing was “particularly interesting” because in 2018 Nunes supported the “Discouraging Frivolous Lawsuits Act”.[137] A filing to quash a subpoena argued that “no reasonable person would believe that Devin Nunes’s cow actually has a Twitter account” as cows “do not have the intelligence, language, or opposable digits needed to operate a Twitter account”.[139] On June 24, 2020, a judge ruled that Twitter was immune from Nunes’s suit because of Section 230 of the Communications Decency Act.[140]

Nunes may yet get his time in the barrel.

In March 2017 the U.S. House intelligence committee, which Nunes chaired at the time, launched an investigation into possible Russian interference in the 2016 United States elections. On April 6, 2017, he temporarily stepped aside from leading that investigation while the Office of Congressional Ethics investigated allegations (which Nunes denied) that he had improperly disclosed classified information to the public.[3][4] In December 2017 the Republican-majority U.S. House Committee on Ethics closed its investigation without taking any action against Nunes.[5]

In February 2018, Nunes publicly released the Nunes memo, a four-page memorandum alleging an FBI conspiracy against Donald Trump. Nunes subsequently began an investigation of the FBI and the Justice Department for allegedly abusing their powers in an attempt to hurt Trump.[6][7]

[…]

On March 22, 2017, during the House Intelligence Committee’s investigation into Russian interference in the 2016 United States elections, Nunes held a press conference to announce that he had received information that the communications of “some members of Trump’s transition team, including potentially the president himself” had been “incidentally collected” by the intelligence community and “widely disseminated” throughout the intelligence community. He added that it was legal FISA surveillance, and unrelated to Russia.[89] It was later revealed that it involved Russia and the Trump transition team. The surveillance was of multiple phone conversations between Michael Flynn, a member of the transition team, and Russian Ambassador Sergey Kislyak, which occurred after Flynn sought advice from the Trump transition team at Mar-a-Lago, where they discussed what Flynn should tell Kislyak “about the administration’s stance on the sanctions. [Kislyak had contacted Flynn the day before] … members of the team at the president’s Florida estate agree that they do not want Russia to escalate the diplomatic crisis. After the initial call, Flynn [spoke] with Kislyak multiple times by phone and urge[d] him not to exacerbate the situation. U.S. intelligence officials intercept[ed] the calls as part of their routine surveillance of foreign dignitaries.”[90]

Nunes had met his source for the information one day earlier at the White House grounds, with a spokesman for Nunes claiming this provided “a secure location” to view the material.[89] Although Nunes had characterized his intelligence sources as whistle-blowers whose identities he had to protect, The New York Times reported that they were actually White House officials Ezra Cohen-Watnick and Michael Ellis,[91] while The Washington Post reported that along with Cohen-Watnick and Ellis, a third man, National Security Council lawyer John Eisenberg, was involved.[92]

Nunes was widely criticized for sharing this information with the media and the president before briefing his colleagues on the committee.[93] According to Nunes, the intercepted communications came in November, December and January—after Trump won the election but before he was sworn in as president.[94] Adam Schiff, the ranking Democrat on the committee, and House Democratic leadership called on Nunes to recuse himself from the investigation.[4] He also received criticism from Republican Senators John McCain and Lindsey Graham.[95] The latter compared Nunes’s actions to those of the comically incompetent fictional character Inspector Clouseau.[96] Nunes was criticized by Democrats and some Republicans for sharing information on an investigation of the Trump campaign with the administration without communicating it to Schiff, his Democratic Intelligence Committee counterpart.[97]

Nuro becomes first company to receive commercial autonomous vehicle permit from California DMV

December 24, 2020   Big Data
Nuro becomes first company to receive commercial autonomous vehicle permit from California DMV

Hours after announcing that it acquired self-driving truck startup Ike, Nuro revealed it’s the first company to receive permission from the California Department of Motor Vehicles (DMV) to charge a fee and receive compensation for its driverless delivery service. Unlike the autonomous testing licenses the California DMV previously granted to Nuro and others, which limited the compensation self-driving vehicle companies could receive, the deployment permit enables Nuro to make its technology commercially available.

Some experts predict the pandemic will hasten adoption of autonomous vehicles for delivery. Self-driving cars, vans, and trucks promise to minimize the risk of spreading disease by limiting driver contact. This is particularly true with regard to short-haul freight, which is experiencing a spike in volume during the outbreak. The producer price index for local truckload carriage jumped 20.4% from July to August, according to the U.S. Bureau of Labor Statistics, most likely propelled by demand for short-haul distribution from warehouses and distribution centers to ecommerce fulfillment centers and stores.

The California DMV permit allows Nuro to use a fleet of light-duty driverless vehicles for a delivery service on surface streets within designated parts of Santa Clara and San Mateo counties, including the cities of Atherton, East Palo Alto, Los Altos Hills, Los Altos, Menlo Park, Mountain View, Palo Alto, Sunnyvale, and Woodside. The vehicles have a maximum speed of 25 miles per hour and are only approved to operate in fair weather conditions on streets with a speed limit of no more than 35 miles per hour.

“This permit will allow our vehicles to operate commercially on California roads in two counties near our [Mountain View, California] headquarters in the Bay Area. Soon we will announce our first deployment in California with an established partner. The service will start with our fleet of Prius vehicles in fully autonomous mode, followed by our custom-designed electric R2 vehicles,” Nuro chief legal and policy officer David Estrada wrote in a blog post. “We have extensively tested our self-driving technology and built a track record of safe operations over the past four years, including two successful commercial deployments in other states and driverless testing with R2 in the Bay Area communities where we plan to deploy.”

In April, Nuro, which has over 600 employees, secured a permit from the California DMV to test driverless delivery vehicles on public roads within a portion of the San Francisco Bay Area. That followed the issuance of a DMV permit in 2017 requiring that the company employ safety drivers in its autonomous test vehicles on public roads. More recently, in February, the U.S. National Highway Traffic Safety Administration (NHTSA) granted Nuro an autonomous vehicle exemption that allowed the company to pilot its custom-designed R2 delivery vehicles on roads without certain equipment required for passenger vehicles.

For the better part of a year, Nuro’s fleet of Toyota Prius vehicles in Houston, Texas has been making deliveries to consumers from various partners, including Kroger, Domino’s, and Walmart. The company has deployed over 75 delivery vehicles to date, a mix of self-driving Priuses and R2s.

In May, Sphero, the decade-old Colorado-based company best known for its programmable robots, announced Company Six (CO6), a spinoff focused on commercializing intelligence robots and AI-based apps for military, EMT, and fire personnel and others who work in challenging situations. Mum’s been the word since on what exactly that might entail, but today, CO6 took the wraps off of its ReadySight, a one-pound, throwable robot built for “dangerous and difficult” jobs.

Robots are ripe for first responder scenarios, as novel research and commercial products continue to demonstrate. Machines like those from RedZone can autonomously inspect sewage pipes for corrosion, deformation, and debris in order to prevent leaks that could pose health hazards. And drones like the newly unveiled DJI M300 RTK and Parrot Anafi Thermal have been tapped by companies like AT&T and government agencies for maintenance inspections and assistance in disaster zones. CO6 appears poised to carve out a niche in this market, which was estimated to be worth in excess of $ 3.7 billion.

According to CO6, ReadySight streams video over both dedicated first responder and commercial LTE networks. Controlled by a smartphone, technologies integrated into the robot allow for “day and zero light usage” as well as autonomous and semi-autonomous driving and patrolling modes, two-way audio communication, and unlimited range and usage over cellular. In addition to a speaker and a microphone, white light headset and infrared illuminator, a foldable “tail,” and a time-of-flight distance sensor, ReadySight sports a Sony camera sensor with a 120-degree wide-angle lens and lens shield and a motion sensor paired with a front indicator LED.

Sphero spinout Company Six launches throwable, video streaming wheeled drone for first responders

ReadySight can stream to viewers on the web, with streaming plans starting at $ 99 per month and first responder plans starting at $ 149 per month. Both subscriptions include unlimited streaming via priority networks and a free replacement robot if ReadySight is lost in the line of duty.

CO6 envisions ReadySight being deployed in the course of accident investigation, exploring tight or unknown spaces before someone enters, and acting as a sentry to keep eyes on a critical area such as a crime scene. It’s expected to ship in Q3 2021, the company says.

CO6 began as Sphero’s Public Safety Division, the brainchild of former Sphero CEO Paul Berberian and Booth, both of whom have backgrounds in military service. The products and services it hopes to deliver — which will include a cloud-based analytics and monitoring platform — will be designed to maintain safety and situational awareness and improve decision-making in the field for critical incidents and everyday operating environments.

To fund the productization and market entry of its initial products, CO6 raised a $ 3 million seed investment from investors including Spider Capital, with participation from existing Sphero investors, including Foundry Group, Techstars, and GAN Ventures.

Alphabet revenue dropped in Q2 2020, the first decline since going public

(Reuters) — Google parent Alphabet’s quarterly sales fell for the first time in its 16 years as a public company, but the decline was less than expected as many advertisers stuck with the most popular online search engine during the pandemic.

Shares of Alphabet fell 1.2% to $ 1,518.85 after it released the second-quarter results. The stock had rebounded early Thursday to this year’s pre-pandemic high of about $ 1,525.

With its mostly free tools for web browsing, video watching and teleconferencing, Google unit has become a larger part of many consumers’ lives during the pandemic as lockdown orders force people to rely on the internet for work and entertainment.

But advertisers on Google have suffered mass layoffs and other cutbacks during the pandemic, and marketing budgets are often the first to get slashed especially by big clients like travel search engines, airlines and hotels.

Google’s ads business has long trended with the broader economy, and the U.S. economy contracted at its steepest pace since the Great Depression in the second quarter, the Commerce Department said on Thursday.

Google appeared to weather the slowdown better than before, as the pandemic has made the internet more attractive to advertisers than TV, radio and other avenues.

“This quarter, we saw the early signs of stabilization, as users returned to commercial activity online,” Alphabet Chief Executive Sundar Pichai told analysts on Thursday. “Of course, the economic climate remains fragile.”

Alphabet’s overall second-quarter revenue was $ 38.3 billion, down 2% from the year-ago period. Analyst’s tracked by Refinitiv, on average, had estimated a 4% decline to $ 37.367 billion.

The sales decline was the first since the company went public in 2004 and the worst performance since its 2.9% growth during the Great Recession in 2009.

About 66% of Alphabet’s revenue came from Google search and YouTube ads, 12% from ads sold on partner properties online, 8% from its cloud business and 14% from its mobile app store and about a dozen other smaller businesses.

It has adjusted by slowing expense growth. Alphabet’s total costs and expenses rose about 7% from a year ago to $ 31.9 billion in the second quarter, compared with a 12% jump a quarter ago.

Alphabet’s quarterly profit was $ 6.96 billion, or $ 10.13 per share, compared with the analysts’ average estimate of $ 5.645 billion, or $ 8.29 per share.

New data privacy laws, including one that went into effect this month in Google’s home state of California, are also depressing ad prices.

Antitrust regulators in countries across the Americas, Europe and Asia are weighing whether Google has stifled competition on its way to dominating search, mobile software and other businesses, with some bodies even considering forcing it divest parts of its ad operations.

About 2,000 employees last month petitioned Google’s emerging cloud business to scuttle deals with some police agencies, citing racial discrimination concerns. And whether a massive hiring spree will win other cloud clients is uncertain.

Investors may be shifting toward less ad-reliant rivals. Entering Thursday, Amazon and Microsoft, which have smaller ad businesses than Google but bigger cloud units, were trading at 145 times and 35 times their respective earnings over the last 12 months. Alphabet shares were at 30 times earnings over the last year.

Waymo resumes limited autonomous driving testing in Phoenix in first step back to normalcy

Waymo resumes limited autonomous driving testing in Phoenix in first step back to normalcy

Nearly two months after announcing it would halt operations around the country in response to the coronavirus pandemic, Waymo today said it will begin limited driving tests in the Metro Phoenix area starting on May 11. The Alphabet-backed autonomous vehicle startup described this as the first part of a “tiered approach” to gradually relaunch operations with its fleet, with commercial service to follow only after the health and safety of riders can be ensured.

That’s all to say that Waymo’s eponymous Waymo One ride-hailing service, which was put on pause in late March, won’t resume pickups and dropoffs just yet. A spokesperson told VentureBeat that Waymo plans to start accepting riders again in the “coming weeks.” To be clear, the phase of redeployment detailed today only involves safety and test drivers, as well as other employees and contractors working out of Waymo’s facilities.

Waymo says that it is following guidance from the U.S. Centers for Disease Control and Prevention, state, and local authorities as its operations resume, redesigning its facilities to respect social distancing guidelines and spacing out work areas by the recommended six feet. The company has also redefined the use of common areas and limited the maximum capacity for various spaces, and it has created trainings for employees around new safety standards and how to work and move around its facilities.

In line with Arizona guidance, Waymo employees will wear face masks in facilities or vehicles excepting instances where a person is driving alone. The company also says it has deep cleaned its buildings and that it will continue to conduct multiple daily cleanings of its vehicles in partnership with AutoNation. Lastly, Waymo says it is working with an occupational healthcare provider to screen all people before they enter its facilities.

In the near future, Waymo exects to begin driving again in other cities, including San Francisco, Detroit, and Los Angeles. “We’re taking a thoughtful and measured approach towards bringing our driving operations back on the road,” wrote the company in a blog post. “Resumption of our driving operations in these locations will similarly be guided by ensuring the safety and health of our team in line with … [federal and state] guidance.”

In addition to Waymo, Uber, GM-backed Cruise, Aurora, Argo AI, and Pony.ai were are among the companies that suspended their driverless vehicle programs in the hopes of limiting contact between drivers and riders. In the interim, some, like Pony.ai and Cruise, pivoted to autonomous delivery. Others leaned heavily on simulation to continue development even as their fleets were grounded.

Why MDM is the First Step Toward Business Reinvention

February 25, 2020   TIBCO Spotfire

Reading Time: 2 minutes

Managing critical data across the enterprise is an essential step toward business reinvention. That’s why organizations are increasingly turning to master data management (MDM) to solve their siloed data problem and provide a single, trusted view of their data. By providing one trusted place to go for information, MDM enables businesses to make better decisions and improve overall performance.

If you’re looking to adopt an MDM solution, the Constellation ShortList™ is a good place to start narrowing your search. This report is often helpful to organizations when evaluating solutions within technology market categories.

We’re excited to announce that TIBCO EBX™ has been added to the Constellation ShortList for Master Data Management Solutions for the third consecutive time. EBX™ is one of only seven solutions recognized for 2020. For TIBCO, we see the report as a further indication of EBX’s momentum in the MDM market. As a single solution to help organizations govern, manage, and consume all their shared data assets, EBX is proud to meet the threshold criteria outlined below.

For Master Data Management (MDM), this year’s threshold criteria included:

  • Information integration
  • Data quality
  • Data governance
  • Multidomain (i.e., customer, product, supplier, reference data, sites, location)
  • Multiple deployment models: on-premises, in the cloud, hybrid or multi-cloud
  • Industry-specific templates and accelerators
  • Self-service business rules
  • Support for data privacy rules and regulations
  • Customer references

According to Doug Henschen, V.P. and Principal Analyst of Constellation Research, the threshold criteria are determined by capabilities that customers and partners deem critical for that technology space. The Constellation ShortList essentially indicates which solutions cover the capabilities most needed to meet current challenges and address top use cases in that category.

To learn more about how TIBCO EBX is leading in master data management, read Doug Henschen’s Constellation ShortList™ for Master Data Management for Q1 2020.

Constellation is not the only analyst firm that has recognized TIBCO’s master data management. Check out Gartner’s 2020 Magic Quadrant for Master Data Management Solutions to see why TIBCO EBX™ Software was named a Leader for the fourth consecutive time.
